gasworld.com Ltd operates an internet portal to provide a variety of services related to the world-wide industrial gases business through its websites h2-view.com & gasworld.com. These terms and conditions contain important information and describe your rights and responsibilities related to the use of this website and the information available through this website and should be read carefully before acceptance.
1. General
These terms and conditions are incorporated into the agreement (“ the Agreement ”) between gasworld.com Ltd (“ gasworld”) and the user (“ the User ”) for the supply of the service provided on its web-site (“ the Service ”) and to gain access to the data, material, news (“ the Information ”) and other services, which make up the Service. By registering with us and/or using the website, you agree to be bound by the terms of this Agreement.
”gasworld” is providing the Information either in or accessible through this site as a service to customers, vendors, suppliers and other interested parties for informational purposes only. Copies may be downloaded only subject to the provisions below. The user may reproduce portions of the Information for use in the ordinary course of business but may not make any profit from the use of that material other than would be ordinarily made in the course of business. The user may not under any circumstances sell the Information nor, save as expressly provided in this agreement, make or sell any copy or reproduction of it or any copy of it. By either accessing this site or downloading the Information from it, the User agrees to be bound by all the terms of this Agreement; should the User not agree, do not access the Service or download Materials from it.
“the User” means an individual user or company whether or not issued a separate and discrete user ID by completing any registration process.
gasworld may amend this Agreement from time to time. Any changes we make will be effective seven (7) days after notice of any change is provided to the User or the Member, which may be done by means including, without limitation, a posting on the Service or via e-mail. If you object to any such changes, the User must notify us prior to such changes coming into effect, and from the date when the changes take effect you must cease to use the Service. Your use of the Service after notice is provided to you will be deemed an acceptance of such changes. It is your responsibility to ensure that you are aware of, read and understand any amendments to this Agreement.
2. Registration
Registration is a prerequisite for submitting or changing company details for inclusion in the directory. Similarly registration is a prerequisite for submitting information of the company’s products and for placing any form of advertising on the gasworld website.
Registration can be done by completing the registration form on the web site. The registration process includes submitting to gasworld an email address and password. The password is stored in an encrypted form. At the user’s discretion, the email address may be visible to third party users of the Site.
By submitting its application, the registrant affirms that it is or acts for a business and has given correct information around its business and contact details. The registrant hereby warrants that all information will be true, accurate and complete and will immediately inform gasworld of all changes which may occur.
gasworld reserves the right to check such details at any time.
3. Use of the Website
The use to the public areas of the website are free of charge and individuals and companies can search the directory or download information from such areas as and when necessary i.e. have unlimited access to the directory.
Company’s wishing to submit company details for listing in the directory can do so under the membership options available (see “Submit Listing” tab). Basic company information (company name, address, telephone and website details) can be submitted free of charge but any such information supplied should meet the terms set out in 2. above.
Companies wishing to provide additional details and/or subscribe to the various membership levels (silver, gold and platinum) will need to provide more details, including billing or invoicing address, in order to gain a higher profile in the directory or to advertise on the website.
gasworld intends to develop the Service to offer other services which may be only accessible on a subscription basis and so reserves the right to change the terms of access following the provision of due notice.
The User will comply with any instructions relating to the security of the service issued by gasworld. The login parameters allocated by gasworld to the User is for the sole use of the User to enable the User to use the service and gain access to the data supplied by gasworld.
In the event of the User becoming aware or suspicious that any unauthorized person has obtained their password. The User must login and change their password accordingly.
4. Misuse and Prohibited Uses of the Service
gasworld reserves the right to suspend or terminate membership of the Service in the event that we determine that the member’s conduct breaches any of the provisions of this Agreement, including the provisions set forth below.
The User or Member is responsible for ensuring that their use of the Service is in compliance with any applicable laws or regulations. You agree not to:
1. Interfere (or attempt to interfere) with the operation of the Service. Interference includes; interfering with, overcoming or circumventing any security function of the Service, or attempting to do so, or accessing (or attempting to access), any portion of the Service that you are not authorized to access.
2. Post, store, or transmit any unlawful, threatening, defamatory, indecent (obscene) or otherwise objectionable information or material on the website, or undertake any such activity that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
3. Post or transmit any advertising, promotion, or solicitation of goods or services for commercial purposes except in any areas of the Service specifically designated for such purpose.
4. Misuse any e-mail function available on or through the Service. This includes; sending unsolicited commercial e-mail to any account that causes complaints from the recipients, continuing to send commercial e-mail to a recipient if recipient has requested that you discontinue such communication, sending bulk e-mails in the form of “spam”, chain letters or other disruptive transmissions, or forging message headers or otherwise concealing an e-mail address or preventing others from responding to a message, or attempting to do so.
5. Use the Service to post, store, or transmit any information or software that contains a virus, worm, Trojan horse, or other harmful or disruptive component.
5. Privacy and Company Information
In order to use certain parts of the Service, you may be asked to supply personal data. Our policy with respect to the collection and use of your personal data is described below. However, the gasworld directory will require details of the company to be listed and this may or may not include personal contact details for individuals representing the company. These details will be posted if requested by the member but gasworld accepts no liability for disclosure of such personal data.
Registration
Free registration is required to access certain features of gasworld.com. As part of the registration process you are asked for limited personal and demographic information and are required to specify an email address and password that will be used to gain access on subsequent visits. While most of the information we collect is used internally for site analysis and improvement, some of your registration data is used in compiling reports for the manufacturers that list on our site. However, it is important to note that gasworld.com will never disclose, or associate with your site usage, any of your personal contact information , which consists of the following:
• Your Name
• Your Postal Address
• Your Phone Number
• Your Fax Number
• Your E-Mail Address
Some or all of your personal contact information will be sent to manufacturers and vendors when you elect to send requests, place orders or ask for fax literature through our site.
You may also change your profile at any time by logging onto gasworld.com and clicking on the “Update Registration” link in the Service header.
Cookies
gasworld.com uses cookies to automate login. Cookies will be loaded automatically unless your browser is configured to block them. Consult the documentation or help files for your web browser for instructions on setting cookie preferences. We feel that the use of cookies enhances the operation of our site, but they are not required. You can use the core features of gasworld.com with cookies blocked.
6. Security
We use reasonable security methods to protect the data that resides on our servers. However, no security system is impenetrable. We cannot guarantee the security of our servers, nor can we guarantee that information that users supply will not be intercepted while being transmitted to us over the Internet.
7. Links to Other Websites
The Service will contain links to other websites or resources. We do not control the content of such other websites, unless specifically stated, nor have we reviewed or approved any content that appears on such other websites. The User agrees that we shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.
8. Termination
Any Member or User of the Service may cancel and terminate its membership of or listing ingasworld at any time by sending an email to “[email protected]” informing gasworld of the termination or cancellation.
A member who has entered into an advertising agreement (Silver, Gold or Platinum Membership) but wishes to terminate its agreement can do so by giving two months notice if the company has taken out an advertisement for a period of 6 months or more. For those who have taken out an advertisement shorter than 6 months will forfeit any unused months as a cancellation fee.
A Bronze Member who wished to terminate can do so with no notice period and gasworld will remove their Bronze Membership within 7 days of notification but the listing will remain and the Member will forfeit its membership fee for Standard Membership.
Without prejudice to any other right or remedy which may be available to it gasworld.com may terminate the Agreement immediately if the User at any time becomes insolvent or bankrupt or enters into any arrangements with or for the benefit of its creditors or be wound up compulsorily or voluntarily (otherwise than for the purpose of a bona fide reconstruction or amalgamation without insolvency) or has a receiver appointed of all or any part of its undertaking or assets ceases or threatens to cease to carry on business.
Upon termination gasworld.com will cease to make the Service available to the User, all indebtedness of the User to gasworld.com shall become immediately due and the User will forthwith return to gasworld.com all documentation relating to the Service.
gasworld.com shall additionally be entitled to suspend supply of the Service to the User if the User is in breach of the Agreement and may impose a reasonable charge to the User for restoring the Service.
9. Membership Renewals/Status
A company wishing to become a Member of gasworld under the levels stated on the Membership Levels page – apart from Standard Membership – will be invoiced for their subscription, advertisement and/or product launch on submission. Our payment terms are 30 days from date of invoice. Payments may only be made by electronic transfer directly into our nominated bank account or by credit card. Failure to pay the invoiced amount within 30 days will result in suspension of the Membership status and failure to pay within 45 days of date of invoice will result in termination of the agreement.
Bronze and Silver Members will be informed 30 days before the end of their Annual Membership that a renewal is due and what the subscriptions rates will be. A company not paying the renewal charge within 30 days will be suspended from that level until payment is received.
10. Changes to the Service
gasworld.com reserves the right from time to time to make alterations to the Service or any part or parts thereof or to withdraw any part of parts thereof and to make alterations in the times of the availability of the Service and the rules of operation relating thereto and in particular:
to make changes in the normal service hours and in User identification procedures;
to add, amend, delete or otherwise vary all or any of the information contained in the Material;
to withdraw the Service from any particular network through which it is from time to time available or to make the Service available through any additional or alternative network.
If through the fault of gasworld.com the Service is suspended or interrupted or is otherwise temporarily unavailable or a fault occurs in the Service which prevents the User from effectively being able to gain access to the Material during normal service hours, gasworld.com may take all necessary steps to rectify the fault as soon as reasonably practicable but shall not be liable for any loss or damage whatsoever suffered by the User as a result. All conditions, warranties or representation express or implied as to the operation or supply of the Service are hereby expressly excluded.
Governing Law
The Agreement shall be governed by and construed in accordance with the Laws of England and the parties hereby submit themselves to the non-exclusive jurisdiction of the English Courts.
